This Intellectual Property Policy ("Policy") forms part of, and is incorporated by reference into, the Bold Care Terms of Use available at boldcare.in/terms. Capitalised terms not defined here have the meaning given in the Terms of Use. In the event of a conflict between this Policy and the Terms of Use, the Terms of Use prevail.

1. Scope

This Policy applies to:

(a) the website boldcare.in and all subdomains, and any mobile application, progressive web app or storefront we operate; (b) our official brand channels and marketplace storefronts, including listings on Amazon, Flipkart, Blinkit, Zepto, Swiggy Instamart, Nykaa and any other authorised channel; (c) all content we publish, including product pages, editorial and blog content, doctor-consultation material, packaging artwork, photography, video, audio, and advertising creatives; and (d) all content submitted to us by users, customers, reviewers, creators and collaborators.

2. Ownership of Bold Care Intellectual Property

2.1 General

All content on the Site is owned by Bold Care or licensed to Bold Care, and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Designs Act, 2000, the Patents Act, 1970, and applicable international treaties including the Berne Convention and the TRIPS Agreement. Copyright subsists in our works automatically upon creation, whether or not registered with the Copyright Office.

Protected material includes, without limitation:

  • text, editorial copy, product descriptions, FAQs, clinical and educational content;
  • photographs, illustrations, product renders, packaging artwork and label design;
  • video, film, motion graphics, animation, and the audio embedded in them;
  • music, sonic branding, jingles and voice-over recordings;
  • the "look and feel", layout, navigation structure, colour system, iconography and visual grammar of the Site;
  • source code, object code, scripts, stylesheets, APIs and database structures;
  • quiz logic, assessment tools, dosage calculators and consultation flows;
  • product formulations, manufacturing processes, supplier lists, ingredient ratios, customer data models and marketing performance data, held as confidential information and trade secrets.

2.2 Trade marks

The following are trade marks of Bold Care, whether registered or unregistered, and whether or not accompanied by the ® or ™ symbol:

  • the word mark BOLD CARE;
  • the Bold Care logo and logotype;
  • product and sub-brand names including Bold Care Extend, Bold Care Vibe and so on
  • our trade dress, being the distinctive combination of colour, typography, packaging shape and layout used across our products.

Registered marks are held under application/registration numbers in their respective Classes under the Trade Marks Act, 1999. Unregistered marks are protected by the common law of passing off, preserved by Section 27(2) of that Act.

Third-party names, logos and marks appearing on the Site — including those of payment gateways, logistics partners, marketplaces and certification bodies — belong to their respective owners. Their appearance does not imply endorsement of Bold Care by them, or of them by Bold Care, beyond any contractual relationship actually disclosed.

2.3 Designs and patents

Certain packaging configurations, applicator devices and product shapes are protected or the subject of pending applications under the Designs Act, 2000. Any patents or patent applications are listed at boldcare.in/patents. Nothing on the Site is to be read as a licence under any patent.

2.4 Domain names

boldcare.in and trybloom.in are our property. Registration or use of a domain name, subdomain, social handle, app name or marketplace seller name that is identical or confusingly similar to our marks is an infringement and we will pursue it under the .IN Domain Name Dispute Resolution Policy (INDRP) administered by NIXI, under the UDRP for generic top-level domains, and under Section 29 of the Trade Marks Act.

3. Limited Licence to Users

Subject to your compliance with the Terms of Use, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and view the Site and to make a single temporary copy of pages in your browser cache for personal, non-commercial use.

This licence does not permit you to:

  • (a) reproduce, republish, distribute, publicly display, broadcast, transmit or communicate to the public any part of the Site;
  • (b) modify, adapt, translate, or create derivative works from our content;
  • (c) use our content to train, fine-tune, evaluate or ground any machine-learning model, large language model, generative system or dataset, whether commercial or research, without our prior written consent;
  • (d) scrape, crawl, harvest, index, mirror or systematically extract content by any automated means, including headless browsers, bots, or extraction APIs, other than by search-engine crawlers obeying our robots.txt;
  • (e) use our marks in advertising, keyword bidding, metatags, hidden text, hashtags, handles or comparative claims in a manner likely to cause confusion or to take unfair advantage of, or be detrimental to, the distinctive character or repute of the marks;
  • (f) remove, obscure or alter any copyright, trade mark or proprietary notice;
  • (g) reverse engineer, decompile or disassemble any part of the Site, save to the extent that such restriction is prohibited by law;
  • (h) frame, in-line link, or present our content in a way that suggests affiliation, sponsorship or endorsement;
  • (i) resell, or offer for sale, our products outside an authorised reseller agreement, or use our product imagery in such listings.

All rights not expressly granted are reserved. This licence terminates automatically on breach.

4. User-Generated Content

4.1 Licence you grant to us

When you submit a review, rating, photograph, video, testimonial, comment, question, survey response, community post or any other material ("User Content") to the Site or to any Bold Care channel, you grant Bold Care a worldwide, perpetual, irrevocable, royalty-free, sub-licensable and transferable licence to host, store, reproduce, adapt, edit, translate, excerpt, publish, publicly perform, publicly display, distribute and otherwise use that User Content in any media now known or later developed, for any purpose including advertising, marketing, packaging, retail display, investor material and press.

This licence extends to use of your name, handle, city, likeness, voice and photograph as submitted, to the extent you have included them, subject to our Privacy Policy.

To the extent permitted by law, you waive all moral rights (special rights under Section 57 of the Copyright Act, 1957) in the User Content, including the right of attribution and the right to restrain distortion or modification. Where such waiver is not permitted, you agree not to assert those rights against us or our sub-licensees.

4.2 Your warranties

You warrant that:

  • (a) you own or have all rights necessary to grant the above licence;
  • (b) the User Content does not infringe any copyright, trade mark, design, patent, right of privacy, or personality/publicity right of any person;
  • (c) the User Content is not defamatory, obscene, sexually explicit in a manner unlawful under Sections 67, 67A or 67B of the Information Technology Act, 2000, or otherwise unlawful;
  • (d) you have obtained consent from every identifiable person appearing in it;
  • (e) you have not been paid or otherwise incentivised by a competitor to submit it;
  • (f) any review reflects your genuine experience, consistent with the Bureau of Indian Standards guidelines on online consumer reviews (IS 19000:2022) and the Consumer Protection Act, 2019.

You indemnify Bold Care against any claim arising from breach of these warranties.

4.3 No obligation to publish

We may publish, decline to publish, edit for length or clarity, or remove any User Content at our sole discretion, without notice and without liability.

4.4 Unsolicited ideas

We do not accept unsolicited product ideas, formulations, campaign concepts, scripts or business proposals. If you send them anyway, you agree they are non-confidential, that we owe you no compensation, and that we are free to use them without restriction. Nothing in this clause prejudices rights you may have under a signed non-disclosure or development agreement.

5. Creators, Influencers and Collaborators

Content produced for Bold Care by creators, agencies, photographers, editors, models or brand partners is governed by the individual agreement between us and that party. Absent a written assignment complying with Section 19 of the Copyright Act, 1957, copyright vests in the author; our published campaign assets are used under assignment or exclusive licence as set out in those agreements.

Creators must not reuse Bold Care campaign material beyond the scope, territory and term of their agreement, and must not license it onward to any third party, including a competitor.

Any advertising disclosure obligations under the ASCI Guidelines for Influencer Advertising in Digital Media and the CCPA Guidelines for Prevention of Misleading Advertisements, 2022, rest jointly on Bold Care and the creator, and must be honoured in every post.

6. AI-Generated and Synthetic Content

Some material on the Site, and some brand characters, avatars or personas appearing on Bold Care channels, may be created wholly or partly using generative artificial intelligence tools. Where this is the case:

  • (a) Bold Care asserts ownership as the person who caused the work to be created, within the meaning of Section 2(d)(vi) of the Copyright Act, 1957, and, separately, ownership of the prompts, model configurations, training material, character bibles, seeds and post-production work that produced it;
  • (b) any synthetic persona, its name, likeness and voice, are Bold Care trade marks and personality assets and may not be replicated, impersonated, deepfaked or used to produce derivative characters;
  • (c) nothing here is a representation that any given AI-assisted work is protected by copyright in every jurisdiction, and we reserve all alternative rights in contract, trade mark, design, passing off and unfair competition;
  • (d) you may not use Bold Care content or personas as training data, reference images, LoRA inputs, voice models or style transfer sources.

7. Reporting Infringement (Notice and Takedown)

7.1 If you believe we have infringed your rights

Send a written notice to our Grievance Officer (Section 9). To be actionable, the notice must contain, consistent with Rule 75 of the Copyright Rules, 2013:

  1. a description of the work in which copyright or other right subsists, sufficient to identify it;
  2. details sufficient to identify the infringing material and its exact location (full URL, screenshot, timestamp);
  3. proof of your ownership or exclusive licence, and details of any registration;
  4. details sufficient to enable us to contact you — full name, address, email, telephone;
  5. a statement that you are the owner or authorised to act for the owner;
  6. a statement that you believe in good faith that the use is not authorised by the owner, its agent or by law;
  7. an undertaking to file an infringement suit in a competent court and to produce the court order within twenty-one (21) days of the notice;
  8. an undertaking to indemnify Bold Care against any loss arising from a wrongful or malicious complaint.

Consequence: on receipt of a compliant notice, we will disable access to the identified material for twenty-one (21) days. If you do not produce an order from a competent court restraining the material within that period, we may restore it.

Notices relating to trade mark, design, personality or publicity rights should follow the same format, substituting proof of the relevant right.

Do not send a notice for material you are merely unhappy about. Deliberately false or bad-faith notices attract liability, including under Section 60 of the Copyright Act, 1957 (groundless threats) and Section 142 of the Trade Marks Act, 1999.

7.2 Counter-notice

If your User Content was removed and you believe the removal was wrong, write to the Grievance Officer with the material's location, an explanation, and your contact details. We may restore the material at our discretion, subject to any court order.

7.3 Repeat infringers

We will suspend or terminate the accounts of users who repeatedly submit infringing material.

7.4 Our position as an intermediary

To the extent Bold Care hosts third-party content, we act as an intermediary within Section 2(1)(w) of the Information Technology Act, 2000, and claim the protection of Section 79 of that Act read with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Consistent with Shreya Singhal v. Union of India (2015) 5 SCC 1, we act on actual knowledge in the form of a court order or a notification by an appropriate government agency, save where a shorter statutory timeline applies — including Rule 3(2)(b) of those Rules, under which material exposing a person's private area, showing full or partial nudity, depicting a sexual act, or being in the nature of impersonation including morphed images, will be removed within twenty-four (24) hours of a valid complaint.

8. Reporting Infringement of Bold Care's Rights

If you encounter counterfeit Bold Care product, unauthorised resale, copied packaging, cloned websites, fake social handles or misuse of our marks or creatives, report it to rahul@boldcare.in with photographs, listing URLs, seller details and purchase evidence. We investigate every report and will act, including through:

  • takedown requests to marketplaces, hosts, registrars, payment gateways and app stores;
  • INDRP and UDRP domain complaints;
  • civil suits for injunction, damages, accounts of profits and delivery-up under Section 55 of the Copyright Act, 1957 and Sections 134–135 of the Trade Marks Act, 1999;
  • criminal complaints under Section 63 of the Copyright Act, 1957 and Sections 103–104 of the Trade Marks Act, 1999;
  • customs recordal and border enforcement under the Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007; and
  • proceedings under the Consumer Protection Act, 2019 and the Drugs and Cosmetics Act, 1940, where product safety is implicated.

We may, at our discretion, reward materially useful information leading to successful enforcement. Any such reward is discretionary and creates no entitlement.

9. Grievance Officer

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

If you are dissatisfied with the Grievance Officer's decision, you may appeal to a Grievance Appellate Committee constituted under Rule 3A of those Rules within thirty (30) days, at gac.gov.in.

10. Permitted Uses and Fair Dealing

Nothing in this Policy restricts uses permitted by Section 52 of the Copyright Act, 1957 (fair dealing for private or personal use, criticism, review, reporting of current events, and other enumerated exceptions), by Section 30 of the Trade Marks Act, 1999 (honest descriptive and referential use), or by any other applicable statutory exception.

Journalists, researchers and educators may use our logo and product imagery for genuine reporting and commentary. Press assets and brand guidelines are available at boldcare.in/press. Use of our marks must not suggest that Bold Care endorses the publication.

11. Licence Requests

To request permission to use Bold Care intellectual property — including co-branding, affiliate creatives, retail point-of-sale material, or editorial reuse — write to rahul@boldcare.in with the material sought, the intended use, territory, duration, and audience. Permission is valid only if given in writing and signed by an authorised signatory. Silence is not consent, and continued use after a request is not deemed approval.

12. Changes to This Policy

We may amend this Policy at any time. The revised version takes effect on posting to boldcare.in, and the "Last updated" date will change. Continued use of the Site after posting constitutes acceptance. Material changes will be flagged on the Site for at least thirty (30) days.

13. Governing Law and Jurisdiction

This Policy is governed by the laws of India. Subject to any statutory forum with exclusive jurisdiction, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over disputes arising from it.
